Terms of Service

1. What KindredPics is

KindredPics is an invitation-based family photo archive. Each tenant ("family") stores photos and tag data in a private workspace accessible only to invited members.

2. Your account

You sign in with an email magic link. You are responsible for the security of the inbox associated with your account. Sharing your sign-in link is equivalent to sharing your account.

3. Your content

You retain ownership of every photo and piece of metadata (tags, captions, memories) you upload. By uploading, you grant KindredPics a non-exclusive license to store, process, resize, run face-detection on, and display your content to other invited members of the same tenant for the purpose of operating the service.

You represent and warrant that:

• You have the right to upload each photo (you took it, or the subject permits it).
• The photos do not depict child sexual abuse material (CSAM), graphic violence, or content that violates applicable law.
• You are at least 13 years old, or the age of digital consent in your jurisdiction (whichever is greater).
• If a photo identifiably depicts another adult, you have their consent to upload and tag them. If it depicts a minor, you have authority from a parent or legal guardian.

4. Final say on uploads

Each member has final say over the photos they personally uploaded — they can delete their uploads at any time, and tenant admins cannot override that decision. Tenant admins CAN remove a photo if it was uploaded in violation of these terms.

5. Free and paid plans

KindredPics is currently in early access and free to use. Paid plans will be introduced in the future; we will publish their terms here and email all tenants with at least 30 days' notice before any charges occur. Originals are retained for 30 days from upload completion (see Section 7) regardless of plan tier.

6. Prohibited content

You may not upload, store, or share:

• CSAM. We use Cloudflare's CSAM Scanning Tool on every upload and report matches to NCMEC as required by U.S. law.
• Non-consensual intimate imagery, doxxing, or content used for harassment.
• Material that infringes a third party's copyright, trademark, or privacy rights.
• Malware, illegal content, or content prohibited by export control laws.

7. DMCA / takedown

To report content that infringes your copyright or otherwise violates these terms, email takedown@kindredpics.com with the link to the content, your contact info, and a description of the issue. See Takedown form for a structured submission. Our designated DMCA agent will respond within 14 days.

7.1 Counter-notification

If you believe material you uploaded was removed in error, you may submit a counter-notification under 17 U.S.C. § 512(g)(3). Counter-notifications must include the elements required by that section and may be sent to takedown@kindredpics.com.

7.2 Repeat-infringer policy

KindredPics has adopted and will reasonably implement a policy, under 17 U.S.C. § 512(i), of terminating workspace memberships (and, where appropriate, entire workspaces) belonging to users we determine, in our reasonable discretion, to be repeat infringers of others' intellectual-property rights. Two or more substantiated DMCA notices against the same account, or a single egregious violation, may result in termination. Account termination is at our sole discretion.

8. Service termination

We may suspend or terminate access to a tenant for violation of these terms, fraudulent payment activity, or a documented government request. We will notify the workspace host by email and provide a 30-day window to export data unless the violation is severe (e.g. CSAM, court order).

9. Limitation of liability

KindredPics is provided "as is" without warranty. We are not liable for indirect, incidental, special, or consequential damages, including lost photos beyond the recoverable amount through R2 versioning. Aggregate liability is capped at the amount you paid in the prior 12 months.

10. Changes

We may update these terms; we'll post the updated version here and notify tenant hosts by email at least 14 days before the change takes effect for ongoing customers.
